Kolkata, Jan 24: On Friday, the CBI filed an appeal in the Calcutta High Court, requesting the death penalty for Sanjay Roy, convicted in the RG Kar Hospital rape-murder case. A division bench led by Justice Debangsu Basak scheduled a hearing for January 27 regarding the CBI’s appeal, alongside a request from the West Bengal government for the admission of its own appeal on the same grounds. The CBI, represented by Deputy Solicitor General Rajdeep Majumdar, argued for the right to challenge the trial court’s sentence, claiming it was inadequate.
On January 20, a Sealdah court sentenced Roy to life imprisonment, which will last until the end of his natural life, for the rape and murder of an on-duty doctor at the RG Kar Medical College and Hospital on August 9, 2024. The division bench announced that it would hear from the CBI, the victim’s family, and the convict through their legal representatives before making a decision on the state government’s appeal.
The CBI contested the state’s right to appeal, asserting that it, as the prosecution, should lead the appeal based on the inadequacy of the sentence. The state’s Advocate General Kishore Dutta contended in court that a life sentence until death was insufficient for Roy’s crimes and sought the death penalty instead. (PTI)
