New Delhi, Dec 10: Aga Ruhullah Mehdi, a Member of the Lok Sabha representing the Jammu and Kashmir National Conference (JKNC), announced on Tuesday that he intends to introduce an impeachment motion in the Lower House of Parliament against Allahabad High Court Judge Justice Shekhar K. Yadav. Mehdi claims that recent remarks made by the judge demonstrate “hatred and deep-rooted communalism.”
He indicated that a minimum of 100 MPs’ signatures will be needed for the motion to be presented, and he has already received support from 7 MPs.
The NC leader stated that he has discussed this motion with leaders from Congress, the Samajwadi Party, Dravida Munnetra Kazhagam (DMK), and the All India Trinamool Congress, who have assured him of their support and signatures.
Mehdi referred to specific comments made by Justice Yadav during a recent public event.
“I am initiating an impeachment motion in Parliament in accordance with Article 124(4) of the Constitution for the removal of Justice Shekhar K. Yadav, a sitting judge of the Hon’ble High Court of Judicature at Allahabad, based on the allegations outlined in the notice,” the MP from Srinagar stated on the social media platform X.
“I require signatures from 100 members to proceed with this motion. So far, over 7 members including Asaduddin Owaisi, Hon’ble MP from Rajasthan Shri Rajkumar Roat, Bihar MP Shri Sudhama Prasad, and U.P. MPs Mohibbullah Sahab and Ziau Rahman Sahab have signed it, and I express my gratitude for their support,” Ruhullah added.
“I have also conversed with members from INC India, the Samajwadi Party, Dravida Munnetra Kazhagam, and AITCofficial who have assured me they will sign and support the motion after getting approval from their respective party leaders. I remain optimistic that they will back this motion as these parties uphold the values and principles of India,” the NC MP continued.
The draft motion shared by Mehdi on X indicates that the Judge is to be removed from his position “on the charge of proven misbehavior.”
It states: “The statements and actions of Justice Shekhar Kumar Yadav, as evidenced in video recordings and reported by news outlets, violate the foundational principles of judicial conduct and the constitutional mandate.”
The cited “grounds for misbehavior” include that “The Judge’s comments reveal his political biases, hatred, and deep-rooted communalism to any reasonable observer. These unfortunate characteristics make him unfit to serve as a non-partisan judge as required under Article 14 of the Constitution.”
It further mentions: “Justice Yadav has made public statements supporting political matters such as the Uniform Civil Code and has aligned himself with the ideological stance of the political organization Vishwa Hindu Parishad. Through these actions, Justice Yadav has blurred the lines between judicial responsibilities and political activism.”
The draft motion concludes: “Given the aforementioned statements made by Justice Shekhar Kumar Yadav, we, the undersigned Members of Parliament, believe that his continued position is detrimental to the integrity, impartiality, and secular spirit of the judiciary. Therefore, we respectfully request this House to adopt this motion.”
